CREDIT REPAIR AND THE LAW PART 2




Hello, my name is Tim J Thrift Independent Agent and Qualified Field Trainer with
United Credit Education Services.

With the recent down turn in the economy and the credit crunch there have been many unfortunate cases where consumers have been taken advantage of and wrongly represented by Credit Repair Companies. Rightfully so the FTC (Federal Trade Commission) has began “Operation Clean Sweep” In which some 36 so called credit repair companies have been shut down.

As a result of this crack down I have come across much resistance from inquiring consumers about United Credit Education Services Credit Restoration and Education Program. The first question they ask. Is credit repair legal? My answer is YES it is legal and then I explain how it is legal. As a consumer you have a legal right to dispute any inaccurate, erroneous and obsolete information that is negatively impacting your credit score under the FCRA (Fair Credit Reporting Act).

You may Google the FCRA Fair Credit Reporting Act to read or visit the ftc.gov site. Warning this is an 80 plus page document full of legal jargon that will mostly likely put you to sleep. In addition to that I explain to them that United Credit Education Services is in full compliance with the CROA (Credit Repair Organization Act). The CROA is the act or law that mandates compliance of credit repair companies. The very law that is shutting down these credit repair companies who are wrongfully doing business. Below I have copied from the ftc.gov website to show example of this explanation of the CROA.


SEC. 402. FINDINGS AND PURPOSES.(3)


(a) Findings.--The Congress makes the following findings:


(1) Consumers have a vital interest in establishing and maintaining their credit worthiness and credit standing in order to obtain and use credit. As a result, consumers who have experienced credit problems may seek assistance from credit repair organizations which offer to improve the credit standing of such consumers.


(2) Certain advertising and business practices of some companies engaged in the business of credit repair services have worked a financial hardship upon consumers, particularly those of limited economic means and who are inexperienced in credit matters.


(b) Purposes.--The purposes of this title are--


(1) to ensure that prospective buyers of the services of credit repair organizations are provided with the information necessary to make an informed decision regarding the purchase of such services; and
(2) to protect the public from unfair or deceptive advertising and business practices by credit repair organizations.


The second question I am getting is. Is it illegal to charge an upfront fee for credit repair service? Folks this is one area of this business that absolutely just makes me want to scream because of this reason. Any place you go on the internet such as ftc.gov and certainly the credit reporting agencies Trans Union, Equifax and Experian you will read that it is illegal to charge upfront fees for credit repair before any services has been provided. And it is illegal under the law to charge upfront fees. But here is what you will not be told or read unless you go directly to the CROA and read the law. I have provided a copy of the law from the ftc.gov site notice highlighted in below.


(B) does not include--


SEC. 403. DEFINITIONS.(4)


For purposes of this title, the following definitions apply:


(1) Consumer. -- The term 'consumer' means an individual.


(2) Consumer credit transaction. -- The term 'consumer credit transaction' means any transaction in which credit is offered or extended to an individual for personal, family, or household purposes.


(3) Credit repair organization. -- The term 'credit repair organization'--


(A) means any person who uses any instrumentality of interstate commerce or the mails to sell, provide, or perform (or represent that such person can or will sell, provide, or perform) any service, in return for the payment of money or other valuable consideration, for the express or implied purpose of--


(i) improving any consumer's credit record, credit history, or credit rating; or
(ii) providing advice or assistance to any consumer with regard to any activity or service described in clause


(i); and


(B) does not include--


(i) any nonprofit organization which is exempt from taxation under section 501(c)
(3) of the Internal Revenue Code of 1986;


(ii) any creditor (as defined in section 103 of the Truth in Lending Act),
(5) with respect to any consumer, to the extent the creditor is assisting the consumer to restructure any debt owed by the consumer to the creditor; or


(iii) any depository institution (as that term is defined in section 3 of the Federal Deposit Insurance Act) or any Federal or State credit union (as those terms are defined in section 101 of the Federal Credit Union Act), or any affiliate or subsidiary of such a depository institution or credit union.


(4) Credit.--The term 'credit' has the meaning given to such term in section 103(e) of this Act.(6)

United Credit Education Services is a member of a CUSO (Credit Union Services Organization) and affiliated with a Credit Union. Therefore we can legally charge an upfront fee.

HOW TO REBUILD BAD CREDIT

Credit restoration allows you to dispute the negative information reflecting on your credit reports, which will result in an increase in your credit score. Once your credit report is accurate, you can begin to build your credit and prove to lenders that you are credit worthy. To rebuild your credit you need to gain some consumer credit knowledge. If you have had poor credit in the past getting new credit or lenders to extend you credit may prove to be a challenge.

Below are tips on how to get new credit and how to build and maintain good credit habits

1. Getting New Credit. Get a new credit card that is right for you. Be warned that creditors will prey on people with past credit troubles extending credit cards with high interest rates and high fees that ultimately make credit unaffordable. Department store cards and secured cards are usually the easiest to get for people trying to build their credit. Keep new credit applications to a minimum the more you apply for, the more the impact will be on your credit score.
2. Building New Credit Habits. Learn how to spend wisely; otherwise you will end up with the same damaging credit that caused you to rebuild your credit. Educate yourself on credit and put those good habits to use.
3. Rebuilding Your Credit. Keep your credit cards current with no late payments and pay them off each month. Keep your balances low in comparisons with your credit limit. Do not take on too many credit cards that you cannot manage your balances and payments.

When you have had past credit troubles, it can be hard to find credit. Even when you do find credit, the credit terms are horrible with high interest rates and costly fees. It’s not hard to find credit though, once you know where to look.
Here are some helpful hints to get you started.
If you have not received any credit card offers in the mail, consider applying online, at your local bank or retail store. There are thousands of credit lenders available to you. Check http://www.bankrate.com/ for interest rate and fee comparisons for the credit card that is right for you.

Two lenders that are known for extending credit to those with poor or little credit are First Premier Bank and HSBC Bank of Nevada. Lastly, if you can’t find an unsecured credit card, try a secured credit card. A secured credit card is similar to a debit card in that you deposit funds into your account and then make purchases against those funds. The amount that you deposit will determine your credit limit. You will receive monthly bills; however along with paying by check you can also deduct the money that you deposited for payment. In your search for a secured card, look for one that will report as unsecured on your credit report. This will improve your credit score.
When you do make the choice to apply for a unsecured or secured credit card, carefully read the terms of the card, especially if you have less than perfect credit. Credit is available to you, Just be sure to do you research to get the best terms for your life.

CONSUMER CREDIT CARDS: HOW MANY IS TOO MANY?

Most Americans have between 5 and 10 credit cards. Some even carry up to 50. But how many is too many? Experts say that it’s not the number of credit cards you have, but instead how much you spend and how much you can afford to pay off each month.
Be aware that the more credit cards you have, the bigger the risk you pose to yourself to create debt and hurt your credit. Also, each time you open a store credit card 20 points are taken off of your credit score, according to consumer education organizations. Typically this is because store credit cards are available to anyone – even those consumers who otherwise could not get credit.

Some Tips To Keep In Mind
-Keep your debt ratio low. Your credit card balance should be ideally kept to 30% of your limit.
-Make your payments on time. Keep your credit cards current. New late payments can decrease your credit score by up to 100 points.
-Do not close too many credit cards at once. When you close several credit cards at once, your debt to available credit ratio will fall.

Credit cards can be a good thing. Credit cards are a safer way to buy goods instead of carrying cash. They offer you the protection against theft because the money you charge is not taken out before you get to dispute the charge. There is no magic number or limit to the number of credit cards you have, just be wise when applying for credit and using the credit you have.

Recently, the market has seen a lot of foreclosures on homes. In 2007, there were over 2 million foreclosure filings, a rise of nearly 75 percent from the previous year. However, a new phenomenon of short sales has brought new questions of how this will affect consumer’s credit and credit scores.
Short sales happen when there is not enough equity to sell and pay all costs of the sale and a lender agrees to accept less than the amount owed against the home. Not all lenders are willing to do this though. Typically lenders only consider a short sale agreement when the home owner has defaulted on their payments.
A short sale may seem like the answer to avoid foreclosure, however, be aware that a short sale will still result in a lower credit score. The seller in a short sale will have lowered credit score 80 to 100 points versus a foreclosure, which will drop a consumer’s credit score 250 to 280 points. A short sale also can be more favorable than a foreclosure in that sellers of a short sale will be eligible for good interest rates in about 18 months to buy another home versus 36 months in a foreclosure. Talk to a real estate agent or a lawyer when determining whether a short sale or foreclosure is in your best interest.

FICO 08 LAUNCHES IN LATE SPRING

The Fair Issac Corporation, the developer of the widely used FICO credit score, has created a new credit scoring model called FICO 08. Currently, most lenders use consumer FICO scores to determine interest rates, loan terms, insurance rates, etc. FICO scores are also being used to determine utility, rental and employment ability or eligibility.
The new credit scoring model will assist lenders in reducing the cost of default rates on consumer loans between 5 and 15 percent. FICO 08 also has intentions of being more lenient on those consumers who occasionally make a late payment versus those who are consistently late. Consumers with only one late account will be given a slightly higher score than those with several delinquent accounts. These consumers could see a significant drop in their credit score. Similar to the current credit scoring system, FICO 08 will stake into account the same factors, such as payment history, length of credit history, the credit mix, amount of debt and the amount of new credit. Unlike the current credit scoring model, FICO 08 will not take into account an authorized user. The new credit scoring model is expected to launch by late spring. Keep your clients updated as they anticipate the new credit scoring system change.
